This policy also covers serious violations such as female genital mutilation and forced marriages. EU member states are obliged to make these actions criminally punishable by adapting their national legislation within three years of the approval of the directive.
Details on criminalization and sanctions
The directive establishes severe penalties for those guilty of these crimes, with sentences ranging from 1 to 5 years in prison. A list of aggravating circumstances is also introduced, such as crimes committed against minors, partners or ex-partners, public officials and journalists, which can trigger even harsher sanctions.
Protection and support for victims
To guarantee protection and assistance to victims, European legislation requires Member States to adopt specific measures. These include making it easier to report crimes, especially those committed through digital channels, and ensuring that minors involved in such reports are protected before informing the accused. The regulations also protect victims' privacy by preventing the use of information about their past sexual conduct in court proceedings unless strictly necessary and relevant.
Promotion of awareness and prevention
The European Union also aims to promote awareness of the deep-rooted causes of gender-based and domestic violence. Particular attention is paid to the importance of consent in sexual relationships, with the ultimate goal of creating a safer society that respects the dignity of every individual.
